Свобода слова в Україні під час війни: виклики та загрози

Abstract

Метою дослідження є виявлення впливу війни на свободу слова в Україні. Поставлена мета передбачає виконання таких завдань: проаналізувати поняття свободи слова у демократичному суспільстві; дослідити міжнародноправові стандарти свободи слова; узагальнити правові підстави обмеження свободи слова; дослідити історичний контекст розвитку свободи слова в Україні; визначити основні введення інформаційної війни з використанням медіа; охарактеризувати особливості поширення ІПСО в соц. мережах та месенджерах; дослідити виклики та перспективи розвитку свободи слова в Україні. Предметом дослідження є правовий, соціальний і медійний контекст функціонування свободи слова в умовах воєнного стану в Україні. Об'єктом дослідження є свобода слова як соціальне явище в умовах війни. У роботі проаналізовані основні поняття та принципи дотримання та регулювання свободи слова як на державному так і на міжнародному рівні. Проаналізовано основні зміни в дотриманні свободи слова та розглянуті порушення стосовно журналістів за період 2014-2025 рр. Обмеження свободи слова під час військових конфліктів є однією з найактуальніших проблем сьогодення, оскільки військові конфлікти висвітлюють, посилюють і роблять видимими проблеми, які не можна ігнорувати в мирний час і, здавалося б, неактуальні для більшості населення. До них відноситься робота ЗМІ. Найважливішим завданням для нас є контроль за достовірністю інформації, яку ми отримуємо, перевірка цієї інформації та пошук авторитетних джерел, яким можна довіряти.

The purpose of the study is to identify the impact of war on freedom of speech in Ukraine. The goal is to perform the following tasks: analyze the concept of freedom of speech in a democratic society; study international legal standards of freedom of speech; summarize the legal grounds for restricting freedom of speech; study the historical context of the development of freedom of speech in Ukraine; determine the main introductions of information warfare using the media; characterize the features of the spread of IPSO in social networks and messengers; study the challenges and prospects for the development of freedom of speech in Ukraine. The subject of the study is the legal, social and media context of the functioning of freedom of speech under martial law in Ukraine. The object of the study is freedom of speech as a social phenomenon under war conditions. The paper analyzes the basic concepts and principles of observance and regulation of freedom of speech both at the state and international levels. The main changes in observance of freedom of speech are analyzed and violations against journalists for the period 2014-2025 are considered. Restrictions on freedom of speech during military conflicts are one of the most pressing problems of today, since military conflicts highlight, intensify and make visible problems that cannot be ignored in peacetime and, it would seem, are irrelevant for the majority of the population. The work of the media includes these. The most important task for us is to control the reliability of the information we receive, verify this information and search for authoritative sources that can be trusted.
