Б.Розглянуто питання необхідності вдосконалення нормативної бази регулювання воєнних відносин. Здійснено аналіз міжнародного та національного законодавства воєнного права, а також загальних принципів ведення війни. Детально розглянуто основні міжнародно-правові акти, які регулюють воєнні відносини та життя мирних жителів під час збройних конфліктів. Розглянуто питання, які потребують оновлення законодавчого регулювання відносно потреб часу та технічного прогресу. Рассмотрены вопросы необходимости совершенствования нормативной базы регулирования военных отношений. Осуществлен анализ международного и национального законодательства военного права, а также общих принципов ведения войны. Детально рассмотрены основные международно-правовые акты, регулирующие военные отношения и жизнь мирных жителей во время вооруженных конфликтов. Рассмотрены вопросы, которые нуждаются в обновлении законодательного регулирования в отношении потребностей времени и технического прогресса. The article analyses the issues regarding the necessity to improve the normative framework of regulaiting war relations. It conducts an analysis of the international and national legislations on military law, and the general principles of warfare. The article provides a detailed examination of the main international legal acts that are governing military relations and the lives of civilians during armed conflicts. The work focuses on the issues which require updates of the legislative regulation regarding the needs of time and technological progress.Item Проблема легітимності гуманітарних інтервенцій у сучасних міжнародних відносинах(Видавництво Львівської політехніки, 2015) Здоровега, Мар’янаЗ’ясована сутність поняття «гуманітарна інтервенція» та основні підходи її до інтерпретації. Визначено характер суперечностей щодо легітимності застосування гуманітарних втручань у міжнародному праві та на практиці. Проаналізовано особливості застосованих гуманітарних інтервенцій без мандату Ради Безпеки ООН. The problem of Legitimacy of humanitarian intervention in the modern international relations has been clarified in the article. Humanitarian intervention was defined as any kind of foreign intervention into the territory of the state with a use of force aiming to protect the rights of its citizens or foreign citizens when ruling elite of this state has no wish or doesn’t want to do it independently. It has been specified that the basis for intervention outside expect the violation of human rights and citizens in the certain state is usually a civil war. Based on the analysis of the intervention documents the main contradictions concerning the legality of the usage of humanitarian interventions in practice have been defined. The attention has been focused on the contradiction in the international law concerning the permit (article 42 of the UN Charter) and prohibition (article 2) of international humanitarian intervention. The kinds of humanitarian intervention have been distinguished. They are: unilateral humanitarian intervention, collective humanitarian intervention under the aegis of the United Nations ahd humanitarian intervention under the aegis of regional international organizations. The peculiarities of the applied interventions without the mandate of the UN security Council have been examined. The causes of the deligitimation of the practical usage of humanitarian intervention in the international relations have been outlined. They are in the effectiveness of the principles of the interfernce, non-use of the force or the threat of force, peaceful settlement of international disputes, sovereign equality of states, etc.Item Спецслужби у системі міжнародних відносин(Видавництво Львівської політехніки, 2015) Горбач, ОлександрЗроблено комплексний аналіз функціонування спецслужб у системі міжнародних відносин; досліджено історію їх становлення та розвитку; проаналізовано тенденції розвитку вітчизняних структур розвідувальних органів, їх нормативно-правове забезпечення; виявлено низку проблем, які існують у системі українських латентних структур; обґрунтовано необхідність реформування структур та створення механізмів демократичного контролю за діяльністю спецслужб. Functioning of special services in international relations is comprehensively analyses. The history of formation and development of intelligence services is examined. It has been revealed that even in the times of Antiquity and the Middle Ages monarchs used the so-called informants who supplied the necessary information. In foreign relations the function of obtaining information about the power of a neighboring state belonged to messengers. The trends in domestic structures of intelligence agencies and their regulatory support are analyzed; a number of problems that exist in the system of Ukrainian latent structures are revealed; the necessity of reforming the structures and creating mechanisms of democratic control over intelligence activity is justified. The activities of special services, which carry out intelligence work, largely determine the dynamics of international politics. Besides, the role of the intelligence structures within internal and external orientation is identical. The realities of Ukrainian-Russian relations cause a fundamental reform in the Ukrainian intelligence services at all levels. The experience of Ukrainian politicians in 2010–2014 shows that functioning of special state organs did not meet the requirements of a modern democratic society. The systems of carrying out democratic control may differ. Today there is no single model of democratic control over special services activity, but among all these models functional approach prevails. The process of reforming special services is quite complex and ambiguous because of the specifics of their activity. Further research should be focused on a thorough study of all the aspects of special services functioning and a comparative analysis of the information about special services, which is in the public domain. The study of the leading world special services experience should contribute to the birth of a new security system in Ukraine.Item Християнський аспект формування міжнародних відносин в епоху Середньовіччя(Видавницво Львівської політехніки, 2014) Горбач, ОлександрДосліджено історію розвитку міжнародних відносин в епоху Середньовіччя. Доведено, що у період епохи Середньовіччя міжнародні відносини сформувалися як певна система поглядів. Проаналізовано тенденції розвитку міжнародної політики щодо поєднання нових форм, способів координування політичної теорії та практики, появи дипломатії як основного засобу реалізації зовнішньої політики. In the history of world nations vast experience of international political relations has been accumulated, without which future comprehensive socio-political development of mankind is impossible. Developing the strategy and tactics of the state foreign policy, prominent thinkers, political leaders and political scientists formulated the basic principles and the principles of international relations. Practical application of these principles and guidelines sometimes led the states to political success, and sometimes it was the beginning of their crash. The article proved that during the Middle Ages international relations emerged as a belief system which had its goal, the means of its achievement, motivated principles and also its content. The integral system analysis of the history of international relations of the Middle Ages was made, trends of the development of international policy in terms of combination of new forms were analysed, methods of coordinating the political theory and practice, the essence of which is the gradual change of overt aggression of the Ancient times into civilized diplomacy during the Middle Ages. Medieval papal Rome left new concepts in the political thought such as subordination of civilian authority to the universal spiritual one, the possibility to form higher supranational entities and building of a Christian civilization. The origin of the primary means of foreign policy, that is diplomacy, should be considered as the achievement of the medieval Byzantium. Scientific understanding of the history of international relations will have practical significance in the formulation and practical implementation of foreign policy, and can also serve as recommendations to public authorities and political organizations in the formation of tasks aimed at determining the foreign policy of our state vector.Item Цивілізаційна ідентифікація України(Видавництво Львівської політехніки, 2014) Хімяк, ОксанаВизначено цивілізаційну ідентифікацію України, а також досліджено сучасні міжнародні відносини як арену міжцивілізаційної взаємодії та з’ясовано місце України в цьому просторі. Усвідомлення Україною свого цивілізаційного статусу має сприяти як виробленню нею оптимальної моделі соціально-економічного розвитку, так і правильній орієнтації у системі міжнародних зв’язків, що є плюралістичними в основі. The purpose of this paper is to define the civilization identification of Ukraine, as well as to study the contemporary international relations as an arena of interaction among civilizations and the place of Ukraine in this space. In order to achieve this goal and with the consideration of the object under research in the development and interrelationship different research methods are used: comparative, chronological and methods of classification and periodization. Ukraine is a country that has its own civilizational nature and its own interests which do not always correspond to the Western and Eastern projects concerning the place of our country in the world. The awareness of Ukraine of its civilizational status should promote the development of its optimal model of socio-economic development and the clear orientations in the system of international relations. Development of civilizational issues has not only theoretical but also practical and economic value. Ukraine, in fact, being at the junction of several modern civilizations with its intellectual potential should find the format of a dialogue between them. Both Ukraine and the communicating civilizations will benefit from this dialogue. It seems that now the overall geopolitical and geo-economic situation in the Eurasian continent and even the world depends on this. Regarding the development of the country, Ukraine is a country divided into Western Ukraine (mostly Uniate, nationalist, pro- Western) and Eastern Ukraine (mostly Orthodox, Russian-speaking and pro-Russian). Ukraine could be denominated as a model of coexistence of different ethnic groups and civilizations. Civilization choice of Ukraine is not a striving somewhere towards Europe but a way to escape from the web of Russian globalization influence. In terms of civilizational factor Ukraine occupies a unique position, it is a kind of bridge between the Western, Orthodox and Muslim world. In terms of the global distribution of power, Ukraine also has a unique position to provide an effective balance of powers in Eurasia. Thus, the awareness of Ukraine of its civilizational status should promote the development of its optimal model of socio-economic development and also the correct orientation in the system of international relations which are basically pluralistic.Item Особливості формування сучасної державної етнонаціональної політики України(Видавництво Львівської політехніки, 2011) Шипка, НаталяПроаналізовано сучасні політико-правові засади захисту прав і свобод суб’єктів етнонаціональних відносин у контексті формування ефективної державної етнонаціональної політики України. Досліджено концепцію етнонаціональної політики як базового політичного документа для формування моделі етнонаціональної політики держави, розроблення та подальшого впровадження на її основі правових документів. Окреслено позитивні та негативні сторони чергового законопроекту «Про Концепцію державної етнонаціональної політики України». Current political and legal protection principles of subject rights and liberties of ethnonational relations in the context of forming effective state ethnonatinal politics of Ukraine are analyzed in the article. The concept of ethnonatinal politics as basic political document for forming the model of state ethnonatinal politics, elaboration and further implementation of legal documents on its basis are studied in the article. The given article outlines the advantages and disadvantages of the latter bill “About a concept of state ethnonational politics of Ukraine”.
