Замороження активів як інструмент міжнародного впливу на держави-агресори

Abstract

Об’єкт дослідження – міжнародні фінансові санкції. Предмет дослідження – замороження активів як інструмент міжнародного впливу на держави-агресори. Мета дослідження: проаналізувати замороження активів як інструмент міжнародного впливу на держави-агресори, визначити його ефективність, правову природу, труднощі застосування тощо. За результатами проведеного дослідження було: 1) схарактеризовано історіографію та методологію дослідження проблематики замороження активів держав-агресорів як інструмента міжнародної політики; 2) з’ясовано характеристики замороження активів як інструмента санкційного впливу на держави-агресори; 3) на прикладах окремих держав продемонстровано особливості замороження їх активів, оцінена результативність фінансової санкції замороження активів (кейси Іраку, Лівії, Ірану, Афганістану) [1; 3]; 4) досліджено питання замороження російських активів та використання прибутків з їх обігу на потреби України; 5) розглянуто проблему конфіскації російських заблокованих активів на користь України [2; 5]. Відзначено, що нині відбувається вепонізація фінансів, коли фінансові активи стають видом зброї у протистоянні держав. Фінанси стали інструментом не лише сучасної геоекономіки, а й геополітики. Фінансові санкції хоч застосовуються часто як інструмент запобігання конфліктам і розбудови миру, але на практиці вони часто не здатні зупинити насильство. Найбільшою проблемою нині вбачається не стільки замороження активів держав-агресорів, скільки можливість їх подальшої конфіскації й не допущення при цьому порушення міжнародного права та ризиків для глобальної фінансової системи [4; 5].

Study object – international financial sanctions. Scope of research – freezing of assets as an instrument of international influence on aggressor states. Goal of research: to analyse the asset freeze as an instrument of international influence on aggressor states, to determine its effectiveness, legal nature, difficulties of application, etc. The results of the study include: 1) the historiography and methodology of the study of the issue of freezing the assets of aggressor states as an instrument of international policy were characterised; 2) the characteristics of asset freezing as an instrument of sanctions influence on aggressor states were clarified; 3) the author demonstrates the peculiarities of freezing their assets on the examples of certain states and assesses the effectiveness of the financial sanction of asset freezing (cases of Iraq, Libya, Iran, Afghanistan) [1; 3]; 4) the author examines the issue of freezing Russian assets and the use of the proceeds from their circulation for the needs of Ukraine; 5) the author considers the problem of confiscation of Russian blocked assets in favour of Ukraine [2; 5]. It is noted that today there is a weponisation of finance, when financial assets become a weapon in the confrontation between states. Finance has become an instrument not only of modern geoeconomics, but also of geopolitics. Although financial sanctions are often used as a tool for conflict prevention and peacebuilding, in practice they often fail to stop violence. The biggest problem today is not so much the freezing of assets of aggressor states as the possibility of their subsequent confiscation and prevention of violations of international law and risks to the global financial system [4; 5].
