Створення, інституціоналізація та правове регулювання Blockchain (Блокчейн): аспекти міжнародного досвіду

Abstract

Висвітлено дискусійні питання історії створення технології Blockchain та аспекти міжнародного досвіду її інституціоналізації та правового регулювання. Стверджено, що витоки досліджуваної технології пов’язуються з іменами двох англійських винахідників Стюарта Хабера та У. Скотта Сторнетта. Вони 1991 року отримали алгоритм розподілених записів, які загалом асоціюються з Blockchain. Наголошено, що повноцінний поштовх розвитку технології дала опублікована 2008 року праця анонімного автора під псевдонімом Сатоші Накамото. Описана в ній в технічних деталях повністю децентралізована система електронної готівки на основі Blockchain невдовзі була сприйнята як можливість універсального рішення для різних сфер життєдіяльності суспільства. Простежено процес інституціоналізації Blockchain. Висловлено розуміння інституціоналізації як визначення порядку або навіть заведення певної традиції застосування, оформлення організацій, правових та інших структур для розвитку цієї технології у світі. Зроблено висновок, що інституціоналізація Blockchain співвідносився з усвідомленням неабиякого потенційного впливу технології як інструменту вдосконалення життя суспільства в найближчі роки і десятиліття. Наведено приклади інституціоналізації технології. Наголошено на активізації процесу інституціоналізації Blockchain з 2018 р., коли на міжнародному рівні було прийнято низку документів і рішень, спрямованих на дослідження проблем Blockchain загалом, і пошуку сфер його найбільш ефективного використання, зокрема. Проаналізовано особливості правового регулювання Blockchain в державах найбільшого поширення технології. Акцентовано на тому, що нині лише напрацьовується спільне правове поле та відбувається впровадження моделей Blockchain у різні сфери господарювання. Зазначено, що правове регулювання таких відносин нині дуже нерівномірне. Підкреслено, що Blockchain досить складно обмежити тільки однією юрисдикцією. Висловлено припущення, що причиною цього – технічні особливості технології.

Discussion issues of the history of Blockchain technology creation and aspects of the international experience of its institutionalization and legal regulation are covered. The process of Blockchain institutionalization is traced. The understanding of institutionalization as the definition of the order or even the establishment of a certain tradition of application, design of organizations, legal and other structures for the development of this technology in the world. It is concluded that the institutionalization of Blockchain was associated with the realization of the significant potential impact of technology as a tool to improve the lives of society in the coming years and decades. Examples of institutionalization of technology are given. Emphasis is placed on intensifying the process of institutionalization of Blockchain since 2018, when a number of documents and decisions were made at the international level aimed at studying the problems of Blockchain in general and finding areas for its most effective use, in particular. The peculiarities of Blockchain legal regulation in the countries with the greatest distribution of technology are analyzed. It is emphasized that currently a common legal field is being developed and Blockchain models are being implemented in various business areas. It is noted that the legal regulation of such relations is currently very uneven. It is emphasized that Blockchain is quite difficult to limit to only one jurisdiction.
