| dc.description.abstract | Дана публікація стосується концептуального оновлення стандартів захисту прав людини за рахунок так званих цифрових прав. Відзначено вплив цифрової революції на права людини в об’єктивному та суб’єктивному розумінні. Пояснюється існування цілого спектру підходів до розуміння цифрових прав від виділення окремої категорії нових прав до оновлення старих прав. Наведено два способи законодавчого впровадження: «конституалізація цифрових прав» та «цифровізація конституційних прав». Результати дослідження показують, що явище цифрових прав супроводжується рядом дилем. This publication examines the conceptual update of the standards of human rights protection due to the so-called digital rights. The authors emphasize the impact of the digital revolution on human rights in an objective and subjective meanings. The existence of the range of approaches to understanding digital rights is explained: from a separate category of new rights to the renewal of old rights. Two methods of legislative implementation are given: "constitutionalization of digital rights" and "digitalization of constitutional rights."
