Abstract
У статті досліджується перелік джерел міжнародного права з врахуванням прогресивних для свого часу ідей Людвіка Ейрліха. Розглядається поняття джерел у формальному та матеріальному значеннях, а також їхні класифікації (звичаєві та встановлені). Особлива увага приділяється природі міжнародного звичаю та доказам його існування. Автор узагальнює допоміжні засоби встановлення норм міжнародного права та відзначає роль рішень Комісії ООН з міжнародного права. У статті розвивається концепція загальних принципів права, визнаних цивілізованими націями. Відзначено, що ерліхове вчення про джерела міжнародного права сприяє наближенню теорію до практики, що пояснюється фактами з біографії вченого. The article discusses the list of sources of international law, taking into account the ideas of Ludwik Ehrlich that were progressive to their time. The notion of sources in material and formal meanings and their classifications (customary and established) are considered. Special attention is paid to the nature of international custom and its evidences. The author summarizes the auxiliary means for establishing norms of international law and estimates the role of the decisions of the UN Commission on International Law. The concept of general principles of law recognized by civilized states is developed. The article summarizes that Ehrlich's doctrine of sources of international law contributes to approaching theory to practice, which is explained by some facts of his biography.
