Сучасні тенденції цифровізації публічного адміністрування

Abstract

Стаття присвячена дослідженню сучасних тенденцій цифровізації публічного адміністрування. Загалом позитивно оцінюється тенденція переведення сфери публічного адміністрування у цифровий формат, адже громадянам цифровізація спрощує комунікацію з владою та усуває корупційні ризики, а для держави цей процес означає оптимізацію та прозорість у діяльності. Розглянуто досвід Німеччини у сфері цифровізації публічного управління, який може стати орієнтиром та еталоном для подальшого розвитку цифровізації в Україні. Важливим кроком у сфері цифровізації публічного адміністрування є запровадження в Україні системи «Custody Records», яка передбачає можливість забезпечення детальної фіксації всіх дій щодо затриманої особи. Наголошено та тому, що запровадження системи «Custody Records» має подвійну мету: по-перше, гарантувати належне поводження зі затриманими особами, по-друге, захистити права поліцейських, яких нерідко безпідставно звинувачують у неправомірних cтосовно затриманої особи. Водночас експерти наголошують і на негативних моментах функціонування системи, як-от: можливість порушення конфіденційності під час спілкування затриманого із адвокатом, оскільки таке спілкування відбувається через прозоре скло за допомогою телефону і можливе прослуховування розмови. Крім того, повсюдна відеофіксація також не сприяє довірі затриманої особи захиснику і може оцінюватися як перешкоджання праву на отримання правової допомоги. Звертається увага на потребу проведення навчань, тренінгів для інспекторів з дотримання прав людини (Сustody Officer), які вносять всі дані щодо затриманої особи в електронну базу. Впровадження системи «Custody Records» в усіх ізоляторах тимчасового тримання та управліннях поліції потребує збільшення кількості таких осіб, які мають бути належно обізнані з особливостями роботи з системою, оскільки саме вони є основними суб’єктами забезпечення стандартів прав затриманих осіб.The article is devoted to the study of modern trends in digitalization of public administration. In general, the tendency to transfer the sphere of public administration to a digital format is positively evaluated, because for citizens, digitalization simplifies communication with the authorities and eliminates corruption risks, and for the state, this process means optimization and transparency in activities. The experience of Germany in the field of digitization of public administration, which can become a reference point and standard for the further development of digitization in Ukraine, is considered. An important step in the field of digitalization of public administration is the introduction of the Custody Records system in Ukraine, which provides for the possibility of ensuring a detailed recording of all actions regarding a detained person. It was also emphasized that the introduction of the «Custody Records» system has a double purpose: firstly, to guarantee the proper treatment of detained persons, and secondly, to protect the rights of police officers, who are often unjustly accused of wrongful actions in relation to a detained person. At the same time, experts also emphasize the negative aspects of the system’s functioning, such as the possibility of a violation of confidentiality when the detainee communicates with the lawyer, since such communication takes place through a transparent glass using a telephone and possible eavesdropping of the conversation. In addition, widespread video recording also does not contribute to the trust of the detained person in the defense and can be considered as an obstacle to the right to receive legal aid. Attention is drawn to the need for conducting exercises and trainings for human rights inspectors (Сustody Officer), who enter all data on the detained person into the electronic database. The implementation of the «Custody Records» system in all temporary detention facilities and police departments requires an increase in the number of such persons who must be properly familiar with the peculiarities of working with the system, since they are the main subjects of ensuring the standards of the rights of detained persons.
