Термінологічні запозичення англіцизмів/американізмів у вітчизняній юриспруденції

Abstract

Зосереджено увагу на процесах сучасного функціонування мови права, в якій виявляються активні зміни в тенденціях запозичення лексичних одиниць в українській правничій мові. Сучасна правова комунікація засвідчує постійну відкритість національної мови до впливів іноземних мов у зв’язку із взаємообміном у цій сфері науки. Це передусім результат діалогу на основі укладеної Угоди про асоціацію між Україною та ЄС. Спостерігається тенденція до нарощування міжнародних контактів у сфері економіки, політики, права. Значним є вплив ЗМІ, масової культури, соціальних компʼютерних мереж. У звʼязку з цим національна мова розширює межі свого функціонування і природного збагачення. Вказано позитивні процеси для розвитку як права, так і юридичної лінгвістики; висвітлено інформаційно-комунікативні дискусії із питань узусу іншомовних слів в усіх галузях науки, а також гострі питання доцільності запозичення американізмів/англіцизмів та їх доречність/недоречність; актуалізовано комунікативнопрагматичні процеси з метою підвищення культури законотворення, шанобливого ставлення до національної мови, інтерсубʼєктивності та гармонійності її збагачення. Розкрито роль мови-донора та української мови, яка набула статусу мови-реципієнта. Назріла потреба не фрагментарних оцінок стану розвитку сучасної галузевої юрислінгвістичної сфери, а формування однозначних критеріїв взаємодії мов та унормування терміносфери юриспруденції на основі зовнішніх і внутрішніх впливів на систему мови та відповідно створення основ для досконалої комунікативної правової практики. Метою статті є аналіз семантичних змін у мові права внаслідок взаємодії мов на рівні наукової правової комунікації.

The article draws attention to the processes of modern functioning of the language of law, which reveals active changes in the trends of borrowing lexical items in the Ukrainian legal language. Modern legal communication testifies to the constant openness of the national language to the influences of foreign languages in connection with the exchange in this field of science. First of all, it is the result of a dialogue based on the concluded Association Agreement between Ukraine and the EU. There is a tendency to increase international contacts in the field of economics, politics, law. The influence of mass media, mass culture, social computer networks is significant. In this regard, the national language expands the scope of its functioning and natural enrichment. The positive processes for the development of both law and legal linguistics are indicated; notable informational and communicative discussions on the use of foreign words in all branches of science, as well as acute issues of the expediency of borrowing Americanisms/Englishisms and their relevance/inappropriateness; actualized communicative-pragmatic processes in order to increase the culture of legislation, respect for the national language, intersubjectivity and harmony of its enrichment. The role of the language of the donor and the Ukrainian language, which has acquired the status of the recipient language, is revealed. There is a need not for fragmentary assessments of the state of development of the modern branch jurisprudential sphere, but for the formation of unambiguous criteria for language interaction and standardization of the terminology of jurisprudence based on external and internal influences on the language system and thus creating a basis for perfect communicative legal practice. The aim of the article is to analyze semantic changes in the language of law due to the interaction of languages at the level of scientific legal communication.
