Вплив штучного інтелекту на культурні права людини

Abstract

Стаття відображає вплив штучного інтелекту на реалізацію культурних прав людини в умовах цифрової трансформації. Аналізується, як новітні технології впливають на доступ до культурних ресурсів, участь у культурному житті та збереження культурної спадщини. Особлива увага присвячується теоретико-правовим та етичним аспектам використання ШІ у сфері культури. Наголошено, що розвиток технологій ШІ створює як нові можливості, так і виклики доступу до культурних ресурсів, збереження культурної спадщини, забезпечення культурного розмаїття та фундаментальних прав людини у контексті культури. Розглянуто проблеми, пов’язані з алгоритмічною упередженістю, монополізацією цифрового контенту, ризиками втрати унікальних культурних елементів у глобалізованому середовищі. Висвітлено роль ШІ у створенні цифрових архівів, аналізі та реставрації історичних артефактів, автоматизації перекладу та персоналізованих рекомендацій, що значно змінюють традиційні підходи до споживання людиною куль- тури. Досліджено вплив ШІ на процеси створення нових культурних продуктів та їхнє поширення. Метою статті є аналіз ключових аспектів впливу ШІ на культурні права людини, виявлення потенційних загроз і вироблення рекомендацій для вдосконалення правового регулювання у цій сфері для сталого втілення прав людини. Окрему увагу присвячено потребі міжнародного та національного правового регулювання, яке покли- кане забезпечити баланс між технологічними інноваціями та захистом культурних прав. Підсумовується, що розвиток ШІ є невіддільною частиною сучасного культурного середо- вища, а належне правове регулювання здатне мінімізувати ризики та сприяти культур- ному розвитку. Підкреслено важливість забезпечення прозорості алгоритмів, підтримки місцевих (локальних) культур і створення міжнародних стандартів. Розробка та вдоско- налення теоретико-правового інструментарію і реальних правових механізмів реалізації та захисту культурних прав людини сприятиме збереженню культурного розмаїття, гуманітарній безпеці та соціальній стабільності в умовах глобалізації. Підкреслюється потреба обережного та відповідального підходу до використання ШІ в культурній сфері, щоб забезпечити справедливий доступ до культурних прав і захистити культурну різно- манітність.The article reflects on the impact of artificial intelligence on the realization of cultural human rights in the context of digital transformation. The author analyzes how the latest technologies affect access to cultural resources, participation in cultural life, and preservation of cultural heritage. Particular attention is paid to the theoretical, legal and ethical aspects of the use of AI in the field of culture. It is emphasized that the development of AI technologies creates both new opportunities and challenges for access to cultural resources, preservation of cultural heritage, ensuring cultural diversity and fundamental human rights in the context of culture. The problems associated with algorithmic bias, monopolization of digital content, and the risks of losing unique cultural elements in a globalized environment are considered. The article highlights the role of AI in creating digital archives, analyzing and restoring historical artifacts, automating translation, and personalized recommendations, which significantly change traditional approaches to human consumption of culture. The article examines the impact of AI on the processes of creating new cultural products and their distribution. The purpose of the article is to analyze the key aspects of AI’s impact on cultural human rights, to identify potential threats, and to develop recommendations for improving legal regulation in this area for the sustainable realization of human rights. Particular attention is paid to the need for international and national legal regulation designed to strike a balance between technological innovation and the protection of cultural rights. It is concluded that AI development is an integral part of the modern cultural environment, and proper legal regulation can minimize risks and promote cultural development. The author emphasizes the importance of ensuring transparency of algorithms, supporting local cultures, and creating international standards. The development and improvement of theoretical and legal tools and real legal mechanisms for the realization and protection of cultural human rights will contribute to the preservation of cultural diversity, human security and social stability in the context of globalization. The article emphasizes the need for a cautious and responsible approach to the use of AI in the cultural sphere in order to ensure fair access to cultural rights and protect cultural diversity.
