Економічна безпека України: кримінологічні детермінанти та кримінально-правовий захист

Abstract

У рукописі досліджуються проблемні питання кримінологічної детермінації та кримінально-правового захисту економічної безпеки. У межах виконаної роботи отримано наукові теоретичні результати, що мають вагоме значення і для науки, і для правозастосовної діяльності. У дисертаційній роботі здійснено спробу переосмислити підходи кримінологічної детермінації та кримінально-правового захисту економічної безпеки в умовах правового режиму воєнного стану, загострення викликів національній ідентичності й суверенітету держави. На основі новітніх доктринальних платформ кримінологічної безпеки доведено взаємозумовленість теорії кримінологічної детермінації та кримінальноправового захисту економічної безпеки. Обґрунтовано доцільність розмежування векторів впливу (загроз) і забезпечення (протидії ризикам) економічної безпеки на детермінанти економічної безпеки і кримінологічні детермінанти економічної безпеки. Візію кримінологічного детермінізму економічної безпеки потрактовано як превалювання захисту безпекової архітектури економіки на засадах обʼєктивно-субʼєктивного реалізму сфери економічної безпеки. У науковому дослідженні наголошено на термінологічній диференціації (неоднаковому трактуванні) дефініцій, використовуваних у нормативноправових актах різних галузей законодавства, що зумовлює потребу уніфікації. The manuscript explores the problematic issues of criminological determination and criminal-legal protection of economic security. Within the framework of the work performed, scientific theoretical results were obtained that are of great importance for both science and law enforcement activities. The dissertation work attempts to rethink the approaches to criminological determination and criminal-legal protection of economic security in the conditions of the legal regime of martial law, aggravation of challenges to national identity and state sovereignty. Based on the latest doctrinal platforms of criminological security, the interdependence of the theory of criminological determination and criminal law protection of economic security is proven. The expediency of istinguishing the vectors of influence (threats) and provision (counteraction to risks) of economic security into determinants of economic security and criminological determinants of economic security is substantiated. The vision of criminological determinism of economic security is interpreted as the prevalence of protection of the security architecture of the economy on the basis of objective-subjective realism of the sphere of economic security. The scientific study emphasizes the terminological differentiation (uneven interpretation) of definitions used in regulatory legal acts of various branches of legislation, which determines the need for unification. Taking into account modern realities and the need for permanent research on the security issue as a fundamental one, it is proposed to establish interaction between legislative institutions and the academic community in the context of forming a center for scientific research on the state of economic security (risks and threats), forming and implementing its preventive mechanisms - in order to ensure criminal and legal protection.
